Responsibility

Market surveillance is the responsibility of public authorities. They have to ensure that products comply with the requirements set out in the relevant legislation.
These actions strengthen health, safety and other aspects of the public interest, like consumer protection and a level playing field for businesses.

Activities

Market surveillance involves two main stages:

Monitoring of products placed on the market:
- Corrective actions to establish conformity:
- When public authorities discover that a product is not in compliance with the provisions of the applicable directives.
- The corrective action depends on the degree of noncompliance.
- Before any action is taken, the party concerned must be notified.
- First, the manufacturer, or the authorised representative, should be obliged to make the product comply with the provisions and to remedy the infringement.
- Ultimately, where other measures have failed or they are not considered as sufficient, all appropriate measures shall be taken to restrict or prohibit the placing on the market and putting into service of the product in question, and to ensure that it is withdrawn from the market.
